1. Purpose and acceptance
These terms of use (the “Terms”) govern access to and use of the AquaTender service (the “Service”): the aquatender.fish website, the aquatender.app web application and the iOS and Android mobile applications, published by Digital Consult SRL, CBE 0808.334.949, VAT BE 0808.334.949 (“we”, “us”).
By creating an account or using the Service, you (“you”, the “User”) accept these Terms. If you do not accept them, do not use the Service.
The Service is intended for private individuals who keep aquariums as a hobby. If you use it in a professional capacity, you act as a professional and certain protections reserved for consumers do not apply to you.
2. Description of the service
AquaTender allows you, among other things, to: record and track water parameters and their history as graphs; plan a stocking list and check parameter and volume compatibility; receive maintenance reminders and keep a logbook; build a photo log; list equipment; and generate shareable cards for forums.
The Service is based on a reference catalogue (species, equipment, parameters, recommended ranges) compiled and maintained by us.
3. Nature of the service — a support tool and the user's responsibility
This section is essential. Please read it carefully.
3.1 AquaTender is a support tool, not an authority
AquaTender is a tracking and decision-support tool. It in no way replaces your own observation, your judgement, your experience, or the advice of a veterinarian or a qualified professional. It does not constitute veterinary advice, a diagnosis, a prescription, or personalised professional advice.
3.2 Catalogue data is indicative
The catalogue information — species, minimum volumes, litres per individual, ranges for temperature, pH, KH, GH, salinity, group sizes, equipment categories — is established to the best of our knowledge, from sources we consider reliable, and is provided “as is”, for purely indicative purposes.
You acknowledge and accept that this information:
- may contain errors, approximations, omissions or simplifications, including in data generated or aggregated automatically;
- reflects general values and does not take account of your particular situation (strain, origin, age, state of health, temperament of the individuals, biotope, actual cohabitation, seasonality, quality of tap water, etc.);
- may be debated within the aquarium-keeping community, evolve as knowledge develops, or differ from the recommendations of other sources;
- may become out of date between updates.
The calculations offered (tank stocking level, common parameter range between species, minimum volume alert) are estimates derived from general rules and the data available. They guarantee neither actual compatibility between individuals, nor the welfare of the animals, nor the absence of problems.
3.3 Reminders are not a guarantee
Maintenance reminders and notifications are a convenience. Whether they are sent and received depends on factors outside our control (network, device, operating system, settings, third-party notification services, availability of the Service). They may be delayed, duplicated or never arrive. You must not rely on them alone for critical tasks.
3.4 You remain solely responsible
You remain solely responsible:
- for your decisions (purchases, introductions, quantities, treatments, settings, maintenance);
- for the welfare, health and safety of your animals, in compliance with the applicable rules on animal protection and on protected or invasive species;
- for checking the information against additional sources, with a veterinarian or with professionals before taking any significant decision;
- for your installation and its material risks (water, electricity, water damage, floor overloading, etc.);
- for the accuracy of the data you enter — the Service's outputs depend on it directly.
If in doubt, or at the slightest sign of a problem with your animals, consult a veterinarian.
4. Account
Creating an account requires a valid e-mail address and a password. You undertake to provide accurate information, to keep your credentials confidential and to report any unauthorised use to us without delay. You are responsible for the activities carried out from your account.
The Service is not intended for persons under 16 years of age without the authorisation and supervision of a holder of parental authority.
5. Plans, prices and payment
The Service offers a free plan (limited in the number of aquariums and photos, watermarked sharing) and a paid Premium plan, with the features described on the Pricing page.
Current Premium price: €2.99 per month or €24.99 per year, including taxes where applicable. The prices displayed on the site prevail at the time of subscription.
The subscription is automatically renewed on expiry for an identical term, unless terminated before the end of the current period. Termination takes effect at the end of the period already paid for: it does not give rise to a pro rata refund, save where the law provides otherwise or where the Service lacks conformity.
Where the subscription is taken out via the Apple App Store or Google Play, billing, renewal, termination and refunds are governed by the terms of the platform concerned and are managed from your account on that platform.
We may change prices. Any change affecting an ongoing subscription will be notified to you in advance and will only apply from the following renewal, which you remain free to refuse by terminating.
6. Right of withdrawal
If you are a consumer residing in the European Union, you have a period of 14 days from the conclusion of the contract to withdraw from a paid subscription, without giving a reason and without penalty.
AquaTender is a digital service supplied on a continuous basis (a subscription), and not digital content delivered in a single supply. It follows that:
- when subscribing, you may expressly request that access start immediately, during the 14-day period;
- if you nevertheless withdraw within that period, you owe us only an amount proportionate to the period actually supplied up to your withdrawal. The balance is refunded to you within 14 days;
- you only lose your right of withdrawal once the service has been fully performed — which, for an ongoing subscription, does not occur before the end of the subscribed period. We therefore do not ask you to waive that right outright;
- if we failed to provide you with this information and the confirmation of the contract on a durable medium, you would owe us nothing for the period used.
To exercise this right, simply inform us unambiguously at contact@aquatender.fish before the period expires. You may, without being obliged to, use our model withdrawal form (Annex I, Part B of Directive 2011/83/EU).
Where the subscription is taken out via the App Store or Google Play, withdrawal and refunds are handled in accordance with the procedures of the platform concerned.
7. Your content
You retain full ownership of the content you create (photos, measurements, notes, information about your tanks). We claim no ownership rights in it.
You grant us only the non-exclusive, limited and strictly technical licence necessary to host, store, back up, transcode, resize and display this content to you as part of the Service. This licence ends when the content or your account is deleted, subject to temporary technical backups.
You warrant that you hold the necessary rights in the content you publish and that it does not infringe the rights of third parties.
Sharing feature: when you generate a shareable card, you deliberately make the image concerned public via an unguessable link, and you choose to distribute it. You are responsible for that distribution and its content. A public link may be copied, indexed or retained by third parties regardless of your wishes.
8. Acceptable use and reporting
8.1 Acceptable use
You undertake not to: circumvent plan limits or technical measures; disrupt, overload or test the security of the Service; extract on a large scale or reuse the catalogue (scraping); upload unlawful or hateful content, or content infringing the rights of third parties; use the Service for illegal purposes, in particular in connection with protected or invasive species, or species whose keeping or trade is regulated (Regulation (EU) 1143/2014, CITES).
8.2 Reporting unlawful content
AquaTender hosts the content you create and allows, at your request, an image to be made publicly accessible. In accordance with Regulation (EU) 2022/2065 (DSA), anyone may report to us content they consider unlawful by writing to contact@aquatender.fish, stating:
- the exact link (URL) of the content concerned;
- a reasoned explanation of why it would be unlawful;
- your name and e-mail address (except for reports concerning certain criminal offences);
- a statement of good faith as to the accuracy and completeness of your report.
We acknowledge receipt without delay, handle every report in a diligent, non-arbitrary and objective manner, and inform its author of our decision as well as of the available means of redress. If we restrict or remove content, we inform the user concerned, setting out the reasons for the decision and how to contest it.
Point of contact (DSA, Articles 11 and 12): contact@aquatender.fish — languages accepted: French, English.
9. Availability and changes
We provide the Service with the care reasonably expected of a professional. However, we do not guarantee uninterrupted availability or the absence of any error: interruptions may occur (maintenance, incident, third-party failure, force majeure).
These reservations do not affect the legal guarantee of conformity which you enjoy as a consumer (see section 10.1). We do not purport to provide the Service “as is” in the sense of excluding our legal obligations.
We may change, limit or remove features, in particular for technical, security or legal reasons. In the event of a substantial and unfavourable change to a feature of the Premium plan, you may terminate and obtain, where applicable, a refund of the unused portion.
Backups: we implement backups, but they do not constitute a guarantee. Export your important data regularly.
10. Warranties and limitation of liability
10.1 Legal guarantee of conformity
As a consumer, you enjoy the legal guarantee of conformity for digital content and services (Directive (EU) 2019/770, transposed into Belgian law). It applies to the Premium plan as well as to the free plan, as soon as you provide us with personal data.
In the event of a lack of conformity, you may require the Service to be brought into conformity and, if that is impossible, fails or does not take place within a reasonable time, obtain a price reduction or the termination of the contract, without prejudice to damages. These rights may not be set aside or limited by these Terms, and nothing in the sections that follow is to be read as affecting them.
10.2 An obligation of means, not of result
Our undertaking is to make available to you a tracking and support tool operating in accordance with its description. In view of section 3, it involves no undertaking as to any biological or material result: we do not promise the health, survival or welfare of your animals, the stability of your parameters, or the success of a stocking list or an installation.
10.3 Scope of our liability
To the extent permitted by applicable law, we are not liable for:
- the decisions you take and their consequences, the final choice and its assessment being yours (section 3.4);
- the consequences of the inaccuracy of the data you enter or of its interpretation;
- damage resulting from use not in accordance with these Terms or with good aquarium-keeping practice;
- indirect damage: loss of profit, of business, of opportunity, of image or of time;
- an act attributable to a third party we did not choose, or a case of force majeure;
- loss of data where it results from an act not attributable to us.
Where our liability is engaged, it is limited to direct and foreseeable damage. To the extent permitted by law, and except in the case of non-performance of a principal obligation of the contract, it is capped at the amount you have actually paid us during the twelve (12) months preceding the triggering event.
10.4 What is never excluded or limited
Nothing in these Terms excludes or limits our liability:
- in the event of wilful misconduct (dol) or gross negligence, whether ours or that of our servants or agents;
- in the event of harm to a person's life or physical integrity;
- in the event of non-performance of an obligation constituting a principal obligation of the contract, save force majeure;
- where it would affect the legal guarantees and mandatory consumer rights.
Any clause found to be unfair or void is deemed not to have been written, without affecting the validity of the other provisions.
11. Term, termination and inactivity
You may stop using the Service and delete your account at any time from the application or upon simple request.
Return to the free plan: if you end your Premium subscription, your aquariums and photos exceeding the free quotas switch to read-only. No data is deleted merely as a result of this return.
Inactivity: in accordance with the storage limitation principle (GDPR), an account that remains inactive is kept for one (1) year, then deleted after e-mail reminders. See the privacy policy.
We may suspend or terminate your access in the event of a serious breach of these Terms, after a formal notice that has remained without effect where circumstances allow, or immediately in the event of unlawful use or of risk to the Service or to third parties.
12. Data, amendments, governing law
Personal data: see the privacy policy.
Amendment of the Terms: we may amend these Terms. In the event of a substantial amendment, you will be informed by a reasonable means (e-mail or message in the application) at least 30 days before it takes effect. Your continued use of the Service after that date constitutes acceptance; failing that, you may terminate.
Governing law: Belgian law, without prejudice to the more protective mandatory provisions of the consumer's country of habitual residence.
Disputes: in the event of a disagreement, contact us first at contact@aquatender.fish: most situations are resolved that way. Failing that, the courts of the judicial district of Mons have jurisdiction, it being understood that the consumer retains the right to bring proceedings before the court of their domicile and to rely on the mandatory rules of their country.
Out-of-court settlement: you may refer the matter free of charge to the Consumer Mediation Service (Boulevard du Roi Albert II 8 box 1, 1000 Brussels — mediationconsommateur.be).
